No mission is impossible for your notary. He is essential for the drafting of deeds, but his role does not stop there. Let's discover the multiple facets of this legal professional.

Your notary ensures the legal security of your acts

The State delegates to the notary the power to authenticate acts and contracts. By affixing his signature and seal, he gives the act its authentic character. All deeds signed with a notary are said to be "authentic"; they are notarial deeds. It ensures legal security for several reasons:

  • The deed is drawn up by a legal professional, which avoids errors and confusion when the contract is drawn up;
  • It is kept for 75 years (100 years if the deed concerns minors) by the notary who drafted it, which makes it impossible to falsify, lose or deteriorate. You can always request a copy.
  • The content of the authentic act and its date are indisputable. The authentic act has a "date certain", unlike the private deed which, to have this quality, must be registered;
  • The authentic instrument is an instrument that is sufficient in itself. In the same way as a judgement, it has probative value (value of proof) and enforceability, which allows it to be used directly for enforcement procedures (seizure for example), without going through the intermediary of a court decision.
  • Your notary has a duty to advise

    Because of the diversity of his skills, the notary advises his clients in all areas of the law. He provides impartial advice adapted to each situation. This duty to advise is a jurisprudential construction that has developed over time. He therefore engages his responsibility if he fails in this obligation. He must inform the parties on the consequences of their commitments, from a legal, fiscal point of view... It is therefore always preferable to seek advice from your notary before starting a company, buying a property or even getting married. The resulting deeds will have been thought out beforehand, according to your personal situation (single, married...), your professional situation (employee, company director...) and your assets. Nothing is left to chance!

    Your notary has à la carte missions

    The estimation of a property cannot be improvised. Hence the need to entrust this mission to a real estate professional who will carry out your expertise in complete impartiality. Because of his profession, your notary is required to follow the evolution of the real estate market very closely. You can therefore count on the reliability of the notary's real estate expertise. To do so, he relies on a real estate database (PERVAL file) supplied by notaries when they register their deeds. Real estate negotiation can also be part of the services offered by the firm to sellers and/or buyers of a property. Using a notary is to opt for simplicity and to have the assurance of being accompanied, throughout your project, by one and the same person.
